Effective August 17, 2026. The Guide is a starting point for finding local businesses and community resources. Confirm important details directly with a listing before relying on them.
1. Agreement to these terms
These Terms of Use (the “Terms”) govern your access to and use of the East Mountain Business Guide at eastmountainmailer.com (the “Guide”), which is operated by Momentary Utopia, Inc. under the East Mountain Mailer name (“East Mountain Mailer,” “we,” “us,” or “our”). By accessing or using the Guide, you agree to these Terms. If you do not agree, do not use the Guide.
2. What the Guide provides
The Guide is a general informational directory of businesses, nonprofits, community organizations, and public services based in or serving the East Mountains. Listing information may come from listing representatives, public sources, or our own research. We may add, edit, organize, feature, decline, suspend, or remove listings at our discretion.
A listing, category placement, search position, or link does not by itself constitute our endorsement, certification, warranty, or recommendation. Paid or featured placements are advertising. We do not investigate or guarantee a provider’s licensing, insurance, qualifications, safety, legal compliance, availability, pricing, service area, or quality.
3. Verify before you rely
We work to keep the Guide useful, but details can become incomplete, outdated, or incorrect without notice. You are responsible for confirming information directly with the listed organization before visiting, purchasing, donating, hiring, volunteering, or making another decision. This includes names, addresses, hours, contact details, eligibility requirements, prices, credentials, and service availability.
The Guide is not legal, medical, financial, safety, emergency, or other professional advice. Do not use it as a substitute for qualified advice or emergency services. In an emergency, call 911 or the appropriate local authority.
4. Third-party organizations and links
Listed organizations are independent third parties unless we expressly say otherwise. Your communications, transactions, appointments, donations, or other dealings with them are solely between you and that organization. Third-party websites and services have their own terms and practices, and we are not responsible for their content, availability, security, or conduct.
5. Permission to use the Guide
Subject to these Terms, we grant you a limited, revocable, nonexclusive, nontransferable permission to access and use the Guide for personal or internal informational purposes. You may link to public Guide pages and share individual listings for ordinary, non-misleading purposes.
The Guide’s original text, graphics, branding, software, and any copyrightable selection, coordination, or arrangement of content are owned by us or our licensors and are protected to the extent provided by law. Individual facts and third-party names or materials may belong to others or may not be subject to copyright. These Terms do not claim ownership of facts you lawfully obtain independently of the Guide.
6. Prohibited uses
You may not use the Guide to:
- scrape, crawl, harvest, download, monitor, or extract listings or other Guide content in bulk by automated or manual means, except for ordinary indexing by public search engines that follow our technical instructions;
- create, populate, improve, or sell a competing directory, marketing list, lead database, data brokerage product, or artificial-intelligence training dataset using content obtained from the Guide;
- republish, license, sell, or commercially exploit a substantial portion of the Guide or systematically copy individual listings;
- send spam or unlawful solicitations, harass listed organizations, misrepresent your identity or affiliation, or imply our endorsement;
- bypass access controls, interfere with the Guide, introduce malicious code, probe for vulnerabilities, or place an unreasonable load on our systems; or
- use the Guide in violation of law or another person’s rights.

7. Corrections and intellectual-property concerns
If you represent a listed organization or believe information is inaccurate, outdated, infringing, or otherwise improper, email emm@momentaryutopia.com. Please identify the listing, explain the requested change, provide current supporting information, and state your relationship to the organization. We may ask for verification before acting.
8. Availability and changes
We may change, suspend, or discontinue any part of the Guide at any time. We may also restrict or terminate access when we reasonably believe a user has violated these Terms or threatens the Guide, its users, or listed organizations. We do not promise that the Guide will always be available, secure, or error-free.
9. Disclaimers
To the fullest extent permitted by law, the Guide and all Guide content are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of accuracy, completeness, timeliness, merchantability, fitness for a particular purpose, title, and noninfringement. Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.
10. Limitation of liability
To the fullest extent permitted by law, Momentary Utopia, Inc. and its officers, directors, employees, agents, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits or data, or harm arising from reliance on a listing, dealings with a listed organization, third-party content, or inability to use the Guide. Our total liability arising out of or relating to the Guide will not exceed the greater of $100 or the amount you paid us specifically to use the Guide during the 12 months before the event giving rise to the claim. These limits apply regardless of the legal theory and even if we were advised that damage was possible. Some jurisdictions do not allow certain liability limits, so some limits may not apply to you.
11. Indemnity
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Momentary Utopia, Inc. and its officers, directors, employees, agents, and affiliates from claims, liabilities, damages, judgments, losses, and reasonable costs arising from your unlawful use of the Guide, your violation of these Terms, or your infringement of another person’s rights.
12. Governing law and disputes
New Mexico law governs these Terms, without regard to conflict-of-law rules. Any dispute arising from these Terms or the Guide must be brought in a state or federal court with jurisdiction in New Mexico, and you consent to the personal jurisdiction of those courts. Nothing in these Terms prevents either party from seeking appropriate relief in small claims court or emergency injunctive relief where available.
13. Changes to these Terms
We may update these Terms as the Guide or applicable requirements change. We will post the revised Terms here and update the effective date. Changes apply prospectively when posted unless a later date is stated. Your continued use of the Guide after a change takes effect means you accept the revised Terms.
14. General terms
These Terms are the entire agreement between you and us concerning use of the Guide. If any provision is found unenforceable, it will be modified only as much as necessary and the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver. You may not assign your rights under these Terms without our consent; we may assign ours in connection with a reorganization, merger, sale, or transfer of the Guide.
